Abstract. The author of the publication considers the car sharing agreement as a relatively new phenomenon, from which relations arise that are not yet fully regulated by national legislation. The author emphasizes that although in many aspects the conclusion of a car sharing agreement has a number of advantages, the legal regulation of this type of agreement has a number of gaps and shortcomings in the legislation. Particular attention is paid to the comparison of the car sharing agreement with other civil law agreements and the analysis of similarities and differences between them. The publication is devoted to the study of the economic and legal nature of the car sharing agreement, its conditions and the legal status of its participants, as well as the analysis of the financial performance of companies providing car sharing services in the Russian Federation. The article also raises questions about the application of certain types of vehicle insurance provided by the largest Russian car sharing organizations. On the basis of the chronology of the formation of the legislation of the Russian Federation in the field of carsharing relations, the features and conditions characteristic of the contractual model of carsharing are analyzed and the judicial practice on disputes arising from this agreement is considered. The author emphasizes that the legislation of Russia has not yet had time to adjust and adapt to the new relations that have arisen in connection with the provision of carsharing services, but at the same time, the regulatory consolidation of the institution of carsharing is necessary to resolve a fairly large number of litigation arising from a rather rigid system of fines and hidden double responsibility to users of this type of service. For a detailed consideration of the issue of the size of the legal liability of car sharing users, the author analyzes and compares the conditions for its occurrence on the basis of agreements with car sharing companies and the features of its consideration in the courts, calculates the economic performance indicators of car sharing activities.
